The Primrose Path Homeowners Association board members were happy when Joe Smith volunteered at the annual meeting to serve as treasurer. But a week later, a board member discovered in an online search that Smith was denied permission to practice law in another state based on a recommendation of that state's bar association, which concluded he had acted recklessly with clients' money. Several board members want to force him to resign, but others say he has been helpful in straightening out the association's financial records and want him to stay. So far, the board hasn't notified other residents in the community.
Should the board ask the treasurer to resign? What should the board do if he refuses? Would the board be negligent if it does nothing?
